These Terms of Service ("Terms") govern your access to and use of the Check2Crypto website, mobile or web application, and related services (collectively, the "Services") provided by ALMOST A BANK, LLC ("Company," "we," "us," or "our"), a Florida limited liability company with its principal business address at 879 Mason Ave, Daytona Beach, FL 32117. By using the Services, you agree to these Terms and to our Privacy Policy, AML/KYC Policy, Risk Disclosure, and Prohibited Use Policy, each incorporated by reference.

1. Acceptance of Terms

You must be at least 18 years of age (or the age of majority in your jurisdiction) and legally capable of entering a binding contract. If you use the Services on behalf of a business, you represent that you have authority to bind that entity. If you do not agree to these Terms, you may not access or use the Services.

2. Description of Services

Check2Crypto allows eligible customers to upload checks online and request payout in supported digital assets (currently USDC and ETH, where permitted) after identity verification, check verification, compliance review, approval, and applicable check-clearing procedures. The Services are money transmission and check-cashing related activities conducted by a registered Money Services Business—not a securities exchange, trading platform, investment service, or DeFi protocol.

3. Eligibility

Services are offered only to customers who meet our eligibility standards, including residency, identity verification, sanctions screening, and jurisdictional requirements. We may refuse, suspend, or terminate any customer or transaction at any time. Digital asset payouts are available only where legally permitted.

4. Account Registration

You must register for an account and provide accurate, current, and complete information. You are responsible for safeguarding login credentials and for all activity under your account. Notify us immediately of unauthorized access at [email protected] or (719) 310-5065.

5. Identity Verification

You agree to complete Know Your Customer (KYC) and, where applicable, Know Your Business (KYB) verification, and to provide any additional documents we request. Services may be unavailable until verification is satisfactorily completed and remains subject to ongoing review.

6. Eligible Check Types

We accept submissions in three categories, each subject to separate rules and documentation requirements:

Not all checks within these categories are accepted. We may decline cashier's checks, money orders, third-party checks, stale-dated checks, or any instrument that fails verification. Amount limits and hold periods apply.

7. Check Submission Requirements

You may submit only checks you are legally authorized to negotiate or deposit. You must provide clear images, accurate MICR and amount data, and truthful payee and payor information. Endorsements must comply with our instructions. Submitting fraudulent, stolen, altered, forged, or counterfeit instruments violates these Terms and applicable law.

8. Check Review, Clearing, and Approval

Every check undergoes verification, fraud review, AML/sanctions screening, and internal approval. We do not guarantee acceptance, approval, or payout. Checks may be held for clearing, returned unpaid, or declined. We may reverse or claw back payouts if a check is returned, disputed, or determined to be invalid, to the extent permitted by law.

9. Digital Asset Payouts

Approved payouts may be delivered in USDC or ETH to a wallet address you confirm in the application. Payout timing depends on verification, clearing, compliance, and network conditions. Payouts are not guaranteed and are not instant. You acknowledge digital asset risks described in our Risk Disclosure.

10. Fees

You agree to pay all fees disclosed before you submit or approve a transaction, including:

Blockchain network (gas) fees and third-party fees may apply separately. See our Fees page. Fees are generally non-refundable if a check is declined after submission, except where required by law.

11. Wallet Address Responsibility

You are solely responsible for providing a correct, supported wallet address and network. Digital asset transfers are generally irreversible. We are not liable for loss resulting from your error, incompatible wallets, or third-party wallet failures.

12. Compliance and Monitoring

We maintain AML, sanctions, and fraud programs. We may request additional information, delay or freeze transactions, file suspicious activity reports, and cooperate with regulators and law enforcement as required or permitted by law.

13. Restricted Jurisdictions and Prohibited Activities

You may not use the Services from prohibited jurisdictions or for prohibited purposes listed in our Prohibited Use Policy, including money laundering, sanctions evasion, or illegal activity.

14. No Investment, Tax, or Legal Advice

We do not provide investment, trading, tax, legal, or financial advice. Check2Crypto is not an investment product and does not offer guaranteed returns, yield, staking, leverage, or derivatives.

15. Service Availability

We do not guarantee uninterrupted access, specific payout assets, or processing timelines. Maintenance, compliance holds, operational limits, and regulatory changes may affect availability.

16. Suspension and Termination

We may suspend or terminate your account or any transaction immediately where required by risk review, policy, or law, with or without prior notice where permitted.

17. Disclaimers

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" TO THE MAXIMUM EXTENT PERMITTED BY LAW. WE DISCLAIM WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT UNINTERRUPTED OR ERROR-FREE OPERATION.

18. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ALMOST A BANK, LLC AND ITS OFFICERS, MEMBERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR DIGITAL ASSET PRICE MOVEMENTS, NETWORK FAILURES, OR LOSSES CAUSED BY YOUR WALLET ERRORS. OUR AGGREGATE LIABILITY FOR ANY CLAIM ARISING FROM THE SERVICES SHALL NOT EXCEED THE FEES YOU PAID TO US FOR THE TRANSACTION GIVING RISE TO THE CLAIM IN THE TWELVE (12) MONTHS PRECEDING THE EVENT, EXCEPT WHERE LIABILITY CANNOT BE LIMITED BY LAW.

19. Indemnification

You agree to indemnify and hold harmless the Company from claims, losses, and expenses (including reasonable attorneys' fees) arising from your breach of these Terms, misuse of the Services, submission of invalid checks, or violation of applicable law.

20. Dispute Resolution and Governing Law

Before initiating formal proceedings, contact customer support at [email protected] or (719) 310-5065 to attempt informal resolution. These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles, except where federal law applies. Exclusive venue for disputes shall be state or federal courts located in Volusia County, Florida, unless otherwise required by applicable consumer protection law.

21. Changes to Terms

We may update these Terms by posting a revised version with a new effective date. Material changes may require additional notice where required by law. Continued use after the effective date constitutes acceptance.
